I think most of the guys n gals will be busy with their paper work for I-485, 765 and 131. I am guessing once the dust settles most of them will come back and contribute generously.

I know most of you know the magnitude of impact IV has in the decision of the reversal of July 2nd update.I am in my 8th year of H1B and I wish IV has arrived 2 to 3 years back, but I am happy better late than never.

Thank you IV and I very much appreciate you keeping the cool when people started second guessing after the AILA update that the situation is 'Fluid'.

    Hi Tina,

Do you know any employer or recruiting agency (in NY) who can help sponsoring physical therapists for 140 & 485.

I got a NY work permit and got my crdentials evaluated but unfortunately that emplyer is no longer having job vacancy. Now I am stuck and don't know if I can get benefit from some other employer.

Any input would be greatly helpful.

Are there any Schedule A professionals who are filing this July?

    Any ideas/news you can share?

Any ideas for those stuck in 40 days employer posting requirements, that will end sometime in August.

Any input will be greatly appreciated.

    Thank you

    Hi ind_game,

For me, 1. I-140 approval in September, 2007 (actually 09/04/2009 as I have the hard copy) has typo. I think your 09/04/2009 should be 2007.

    Please correct.

    My apologies........Can I correct the thread message now........it looks I cannot.......anyway here is the updated....thanks ak_2006

    Here is the scoop.

from US Congresswoman's office, an immigration specialist spoke to their liaison at the Nebraska Service Center.

    Liaison confirmed the following:

    1. I-140 approval in September, 2007 (actually 09/04/2007 as I have the hard copy)
    2. I-140 revocation in Feb, 2009 ( he has not provided the day of the month, but from LUD I have it strongly pointing to 02/03/2009)
I have not told the Congresswoman's office about the I-140 revocation. Just mentioned that it might have happened as I have left the company.

    3. Liaison did confirm that even after the I-140 being withdrawn I am eligible for adjustment thru AC21.

    4. Liaison did agree that if the I-140 was revoked within the stipulated time given in AC21, Nebraskas decision to deny the I-485 may have been in error. (which in my case is true)

Immigration specialist at the Congresswoman's office is going to contact the Director of NSC to review this matter with a supervisor

    Unanswered questions:

    1. If the Liaison can see that my I-140 is approved on 09/04/2007, why is that the adjudicating officer is responding with a denial on 09/04/2007 and subsequent denial of I-485?
    2. Are they both not looking at my information with same interface?

    Conclusion:
Atleast in my case it looks deliberate and intentional.

    hi indio
which cap on Nurse are they talking about. Is it the EB cap or H1B cap?

They voted YES to include amendment to eliminate EB visa cap for Nurses (India, PHI)

Will send the Nursing comm into raptures if it finall passes into law. Strong indications that it will make it. Of course that will have major impact on EB3 numbers, I guess

If extension has already been granted, it remains valid until it's expired, revoked by USCIS, revoked by employer or employer goes out of business. However, H1B status is technically lost (similary to the situation when h1b holder leaves the petitioner but petitioner never revokes h1). Even if USCIS does not revoke the extension, it will be investigated during new I-485 processing/H1 transfer or extension.

If that is the case, then h1b is not an option at all.

It tracks the statuses of around 1800 people....

    http://www.immigrationportal.com/showthread.php?p=1392408#post1392408

This seems to be very extensive tracker. Based on this data, we can make a close analysis of Philadelphia BPC.

In RIR queue, they are currently certifying applications with PD of Sep 2004. We can find some cases with PD later than Sep 04 with status Certified. Those are either lucky ones or those who already reached from SWA to DOL before ended up in BPC. We can find many cases with PD earlier than Sep 04 with status Letter Received. I do not have strong explanation. Those could be either pending in data review or ones who did not care to update their tracking info after being certified or unlucky ones

In Regular (TR) queue, they are still certifying ones that came from DOL.

I am seeing a lot of folks predicting the EB2 dates. And I believe they are right in doing so since that is their filign category. What I am asking is if there are any prediction regarding EB3-I. The dates are not moving at all which is absolutely frustating.

How about people are using it as a loop hole and smack you down. Just because you have the option, it does not mean the right thing.

It is not the right thing -- from your perspective, because you can't take advantage of it. From the USA point of view multinational executives can potentially create jobs and that's why they must be allowed
You may call it "loophole", based on your understanding of it. However the reality may be different and larger than what you see. So don't axe the branch you are sitting on!

dude..dont rain on our parade...everyone knows the harsh realities.. i myself said earlier that only half the battle is won...but the least we deserve is one day of hope.

    Congrats EB2-I !!

I guess the intention of DOS was to enable Consular posts to approve as many EB2 cases as possible inorder to minimize VISA wastage. And also continue to enable USCIS to pick the low hanging fruits.

Otherwise, I dont think USCIS has cleared all pending cases with PD earlier than April 2004.

Yes, EB2 definitely deserves this moment and at the same time EB3 I does not deserve this 'coma' stage in their PD movement.

I think the advantage of LLC against Sole Prop is about liability.

If some one sues your business, LLC offers you protection, but Sole prop. may not.

If you are on EAD, you can start the business in your wife's name. Now the risk is that she will run away and take the business with her; can't say that would really be a bad thing.

S-corp is much more complex compared to LLC.

There is nothing in the law that disallows one from opening and operating LLC or INC type of business. To open a CORPORATION one needs to be a U.S. Citizen as far as I know, but for LLC or Inc no such requirement. Definitely LLC or Inc is better option for the reason you mentioned; liability protection. Thank you.

    people,

i just returned from an infopass meeting... the guy i talked to said that they recently have a directive from the DHS/USCIS that they want to separate the legal stuff from the illegal stuff and hence they are planning to adjudicate a record number of EB apps in the next quarter or two... does anyone else concur? is this true or were my ears just ringing in that meeting?

    --shark

So, did anyone else hear anything similar? i am VERY excited about this... but dont know anything about what to make of it... maybe he was just saying it because my face looked tense?????? ha ha ha... no seriously, i dont know what to make of him and his information...

    Chi_shark
One of my co-worker had a info-pass this friday and the IO told him similar comments to the one which you heard....not sure what to infer out of these comments......

I couldn't believe this. Wonderful news. Thanks

But the downside to this is that most EB2 July filers have (or will be) been renewing their EAD's in August/Sepetember and this bulleting will not let USCIS give out 2 yr EAD's and instead hand out 1 yr ones.

Just because your PD is current dosnt mean that USCIS will process your apps right away. There are folks whose PD was current under July bulletin and their apps haven't been touched based on some anecdotal evidence here..
But the Eb3 news is not good.
    just my 2 cents

Some unused EB #s were recaptured for families in following year. For example, in 1994 there were 29,430 (column 2) unused EB #s. However, 27,721 (= 253,721 (column 3) - 226,000 (family quota)) of these #s were recaptured for families. Thus, only 29,430 - 27,721 = 1,709 (column 4) were un-recaptured.

Also, 50,000 unused EB #s from 01-04 were recaptured for Schedule A.

Finally, unused EB #s in 99 and 00 were recaptured, hopefully for EB.

Thus, unused EB #s are more important then un-recaptured EB #s (mentioned above) since some of them have not been recaptured for EB.

    The unused EB #s is 506,384 (total column 2) - 98,941 (99 recaptured for EB) - 31,098 (00 recaptured for EB) = 376, 345

Annual Report to Congress June 2007 (http://www.dhs.gov/xlibrary/assets/CISOMB_Annual_Report_2007.pdf)

    Macaca;

Here is where the confusion lies with respect to unused, wasted, etc.

The Immigration Act of 1990 (P.L. 101-649) restructured the immigrant categories of admission and made other modifications to the Immigration and Nationality Act.
The 1990 Act divided the preference classes into two general categories: family-sponsored(FS) and
employment-based(EB). Limits on the number of visas issued in these two categories are determined annually.
FS limitsThe worldwide level for FS preferences is calculated as:
480,000 minus the number of aliens who were issued visas or adjusted to legal permanent residence in the previous fiscal year as

    immediate relatives of U.S.citizens
children born subsequent to the issuance of a visa to an accompanying parent
children born abroad to lawful permanent residents on temporary trips abroad

plus unused EB preferences in the previous fiscal year.
The 1990 Act specifies that the family-sponsored limit may not go below a minimum of 226,000 in any year.

EB limitsThe 1990 Act specifies that the worldwide limit on EB preference immigrants is equal to 140,000 plus unused FS-preference visas in the previous year.

If USCIS waste another 11,000 visas this year...it is equivalent to one year visas for one country (9,800 EB visas per country per year)....can you imagine that?

The problem is compounded because applicants who supposedly got the visa this year would get the visa allocation from FY2008. That visa number could have been yours....or mine....

Most media articles on the 485 issue had one common note "This normally not so vocal group of legal working immigrants have stood up and spoke". IV made sure that will not be so anymore and we have a strong resonating voice that will make a difference

Let us agree on the format of letter first:

    ***************
    Suggested Message:
    Hon. Mr. ??,
I would like to register my protest with you for not following an orderly method when approving I-485 applications. In the last two months, while the priority dates were current for several applicants from India in the EB2 category, the applications with later priority dates and later receipt dates got their I-485 approved by USICS. This has generated a great anxiety among those who have been waiting patiently in the line before them.
I being one such affected person, is sending you this letter with a ???? as a symbol of my protest and hope that USCIS will deal fairly with all the applicants in the order of priority and receipt dates of their I-485 applications.
    Thanks

The upper limit should be on a per state basis, at the very least. 150K AGI in CA is not much of a deal. Pretty much all double income families will cross that limit, and quite a few single income ones. Bummer!!

BTW, you can barely afford a Condo or a low end home in Bay Area for 150k AGI.

Not surprising. People who earn $75K (single) or $150K (as a couple) are not the ones who drastically change their lifestyles because of recession or high gas prices. In fact these people are anyways earning much above the national average. It's the low/middle-income folks that bear the brunt of high inflation and soaring gas prices...they are the ones being goaded into spending.

Anyways, think twice before you spend the rebate foolishly. Why not send it to IV, contribute to an IRA or fund your kid's 529 plan?

    Thanks,
    Jayant
